InGenesis Privacy Policy

When you provide information to InGenesis, Inc. (collectively, “InGenesis“, or “we“, “us” and “our“) you trust us to safeguard your privacy, and we are committed to doing so. This Privacy Policy explains:

  • What information we collect and why
  • How we use that information
  • How you can contact us if you have questions

This Privacy Policy applies whenever we collect personal information from or about you. This Privacy Policy does not apply to the practices of third parties that InGenesis does not own or control.

Sometimes InGenesis processes personal information it receives from one of its customers as part of its workforce solutions or talent acquisition services. In that case, InGenesis will process personal information according to the contractual obligations it has with the applicable customer. To the extent InGenesis receives requests from individuals regarding the processing of their personal information by InGenesis in this situation, it will refer them to the privacy officer of the appropriate customer.

Collection of Personal Information

InGenesis collects and maintains personal information concerning the following categories of individuals:

  • Visitors: individuals who visit or use our website or services;
  • Job seekers: individuals that apply for job opportunities with InGenesis to fill our internal positions or as part of our staffing and recruiting services for InGenesis’ customers;
  • Customers, vendors, service providers and other suppliers: employees, representatives and/or agents of our customers, service providers or suppliers with whom we have a business relationship and/or manage on behalf of our customers.

We may collect information in three ways: (1) you may voluntarily provide it; (2) we may collect it automatically (such as internet protocol and login information and similar data); or (3) we may receive it from third parties such as background check providers or other sources such as information from publicly available sites or job applicant references. Some of this information is sensitive personal information. We try to minimize the amount of sensitive personal information we collect or process, but some information is necessary and required or permitted by law to be collected or processed. We will not collect and use any sensitive personal information about you in circumstances prohibited by law.

If you submit any personal information relating to others to us or to our service providers in connection with our sites or services, you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Statement.

Uses of Personal Information

The personal information InGenesis collects is used to:

  • Provide services and information to you;
  • Respond to communications we receive from you;
  • Comply with applicable laws and government regulations;
  • Facilitate a job match between candidates and our customers;
  • Send you e-mails and other communications about InGenesis marketing, advertising and promotions in accordance with your marketing preferences; and
  • Communicate with you about job postings that we think fit your profile.

Personal Information collected online through our sites may also be supplemented with information you provide to us through other InGenesis online or offline services, such as recruiting fairs or tradeshows, as well as through online tagging and tracking methods such as “cookies.” A cookie is a small data file placed on the hard drive of your computer when you visit certain websites. A cookie file can contain information such as a user ID, used to track site and content traffic patterns. You can turn tracking cookies off in your browser, although this may limit the site functionality you experience.

We may also use the personal information we receive for the purposes of creating aggregated statistics that do not reveal the identity of any person.

Sharing with Third Parties and Affiliates

InGenesis may disclose your personal information to any affiliate within InGenesis, including vendors, consultants, and service providers (“Affiliates”) for use in accordance with this Privacy Statement. In particular, we may share your personal information with our customers if you are a job applicant in order to facilitate a job match or provide our workforce solutions services. This sharing of personal information with Affiliates may include combining the personal information gathered by certain InGenesis sites with information gathered by Affiliates. Again, this combined information will only ever be used for the purposes outlined in this Privacy Policy.

In connection with the above, we may disclose certain data about your previous employment (such as criminal background checks, resumes, or identifying information such as your social security number) with that customer or other service providers or agents acting on our behalf to enable potential placement or employment. We may also share aggregated demographic and statistical information with our Affiliates or authorized third parties, provided the information is unlinked to any personal information that can identify an individual person.

We may also disclose personal information to a third party where we are legally required to do so in order to respond to or comply with any applicable law, regulation, or court order.  We may also do so in order to prevent fraud or threats to the safety of any person, or to exercise our legal or other rights or defend against legal claims.

Aside from the purposes described above, we do not sell, rent, or lease your personal information to any third party, unless we have your express written or oral permission to do so, or it is required by law.

Your Rights

You have the right to request copies of and access to your personal information, correct your personal information, delete personal data, and request that we stop sending you any direct marketing communications. Each communication you receive will provide instructions as to how to opt-out of receiving similar communications.

InGenesis and its employees are responsible under Health Insurance Portability and Accountability Act (“HIPAA”) regulations to ensure the strict confidentiality of all protected health information and we will comply with those requirements and other confidentiality requirements imposed by law.

Safeguards and Notification

InGenesis uses physical, electronic, and procedural safeguards to protect against the unauthorized use, disclosure, modification, destruction, or theft of any of your personal information under our control.

In accordance with applicable law, InGenesis shall notify affected individuals of any breach of its security measures involving personal information under its control if it is reasonable to believe that the breach creates risk of significant harm to the individual. Such notice shall be made as soon as possible after InGenesis determines that a breach has occurred.
